II. System Basis of the National Judicial Examination

Since 2002, the MOJ has formulated a series of regulations and normative documents for the National Judicial Examination, forming a legal framework for the National Judicial Examination with the Judges Law of the People's Republic of China, the Public Prosecutors Law of the People's Republic of China, the Lawyers Law of the People's Republic of China and the Notary Law of the People's Republic of China as the legal basis; the Measures for the Implementation of the National Judicial Examination jointly formulated by the Supreme People's Court (SPC), the Supreme People's Procuratorate (SPP) and the MOJ as the implementation regulation; and department regulations such as the Management of the Legal Professional Qualification Certificate and the Measures for the Handling of Disciplinary Violations in the National Judicial Examination together with over 20 normative documents as the major content, covering a variety of procedures, including exam signing up, question producing, examination district setting, organization, security and confidentiality, scoring, handling of disciplinary violations, grade verifying, grant of qualification and certificate application, etc.

According to the Measures for the Implementation of the National Judicial Examination, the National Judicial Examination shall be produced,organized and scored in a unified way nationwide and shall beheld once every year. The topics covered by the Examination shall be subject to the National Judicial Examination Outline formulated by the MOJ. The contents covered by the National Judicial Examination include theoretical jurisprudence, applied jurisprudence, laws in force, legal practice, and legal ethics. The pass score of the Examination shall be determined by the MOJ in consultation with the SPC and the SPP. Anyone who passes the Examination and meet the qualification requirements will be granted the legal professional qualification by the MOJ. The legal profession qualification which is an important administrative licensing function of the MOJ is the admittance professional qualification set by the state, and has been included in the national professional qualifications list.
