Private enterprises to receive all-round judicial protection

Judicial protection for private enterprises and entrepreneurs will not only include protection of personal and property rights but also intellectual property rights (IPRs), personality rights and reputation rights, said Jiang Bixin, vice-president of the Supreme People's Court (SPC), during a ministers' "passage interview" on March 12.

In 2018, the SPC released 13 guiding cases, which has manifested the judicial value orientation of protection of property rights and private enterprises.

In next step, SPC will further expand the judicial protection of private businesses and entrepreneurs' rights and interests and prioritize the protection of IPRs and moral rights like personality and reputation rights.

He added that courts at all levels are required to establish green or expedited passage for cases with clear facts and simple details and use compulsory measures with caution to lower the negative impact of litigation on enterprises.

In addition, more wrongful convictions were rectified and judgment enforcement has been strengthened.

According to Jiang, crimes of illegal businesses, contract fraud, embezzlement of public funds and duty encroachment will be focused on to create a sound and stable business climate in which entrepreneurs can start businesses and make investments.

Meanwhile, judicial interpretations of the above-mentioned crimes will be drafted and accountability mechanisms will be fully implemented to prevent wrongful convictions and guarantee efficient and fair justice.

Passage interviews got their name because they usually take place on walkways leading to the main hall of the Great Hall of the People before or after plenary meetings of the National People's Congress and the National Committee of the Chinese People's Political Consultative Conference. It's the first time that a SPC leading official received such an interview.
