Disney Successfully Defended its Trademark

Winnie the Pooh, a classic cartoon image introduced by The Walt Disney Company (Disney Company), is well-known for its innocent and adorable image. The trademark "Winnie the Pooh威尼熊" which registered on garments by Lingxiu Hongri Knitting Garment Factory (Lingxiu Hongri Knitting Garment Factory) in Shishi City, Fujian Province had caused controversies from Disney Company. Within the legal specified time, Disney Company filed a controversial application against the disputed trademark at the Trademark Review and Adjudication Board of the State Administration for Industry & Commerce of PRC (Trademark Review and Adjudication Board). The Trademark Review and Adjudication Board believed that the disputed trademark "Winnie the Pooh威尼熊" and the reference trademark "WINNIE THE POOH" constitute the similar trademark used on the identical or similar goods, and ruled to revoke the disputed trademark. Unsatisfied with the ruling, Lingxiu Hongri Knitting Garment Factory filed an administration appeal at Beijing Intermediate People's Court. And the first instance of Beijing Intermediate People's Court sustained the ruling of the Trademark Review and Adjudication Board.
