Abstract: Due to the fact that relevant rules on data collection, processing and supervision are not in proper place, some network platforms deal with collected personal data in an indiscriminate manner, leading to public concerns about data security and privacy protection. Besides, such a practice is unfavorable for protecting consumers’ rights and fair market competitions. Some international Internet giants are facing increasingly stringent regulation and scrutiny because of data leak and data abuse and many major developed countries have thus improved legislation and law enforcement for protecting safety and privacy of personal data. Therefore, China needs to flesh out rules for regulating data collection and use of network platforms so as to provide an appropriate and legal way for data use. First, the government needs to accelerate the introduction of laws on personal information protection and legal systems for regulating the collection and use of personal data. Second, it needs to steadily improve standards on collection and use of personal data and enforce supervision of privacy protection. Third, related departments need to focus on improving self-regulation of network platforms and urge them to strictly formulate and implement open and transparent rules on data use. Fourth, efforts need to be made to strengthen market supervision and regulate data competitions between network platforms. Fifth, the government needs to enhance international coordination and cooperation on rules relating to personal data protection.
