Nature, status of NPC

Article 57 of the Constitution of China provides that “NPC of PRC is the highest organ of state power. Its permanent body is NPC Standing Committee.”

All powers in China belong to the people. Organs in which the people exercise state power are NPC and local people's congresses at all levels.

Democratic elections

NPC is created through democratic elections. NPC is centralized embodiment that all state powers belong to the people.

As state highest organ, NPC unifies to exercise supreme power entrusted by Chinese people, responsible to the people and subject to their supervision. No power of other state organs is beyond NPC power.

NPC and NPC Standing Committee exercise state legislative power.

All state organs, armed forces, all political parties, public organizations, all enterprises and institutions and all citizens must strictly abide by laws and resolutions passed by NPC, in order to insure their enforcement.

NPC composition

Article 59 of the Constitution of China provides that “NPC is composed of deputies elected from provinces, autonomous regions and municipalities directly under Central Government and armed forces. All minority nationalities are entitled to appropriate representation.”

Deputy number allocation and their election procedure are prescribed by laws.

Number allocation shall not exceed 3,000.

NPC number allocation shall be assigned by NPC Standing Committee in accordance with "equality of all, regional equality and national equality" principle.

Ethnic minorities with extremely small populations should have at least one deputy of their own.
