What are the functions and powers of NPC Standing Committee?

According to the Constitutional provisions of China, the functions and powers of the NPC Standing Committee are:

Legislative power

Supervisory power

Power of election and personnel appointment and removal

Power to make decisions on major issues

Other functions and powers.

Legislative power

1. Power to interpret Constitution and supervise its enforcement

2. To exercise legislative power within the scope of Constitutional provisions

3. Functions and powers to interpret laws

Supervision power

1. To listen to and deliberate special work report on “government, courts and procuratorates”

2. To examine and approve final account, to listen to and deliberate report on national economic and social development planning and implementation of budgets, to listen to and deliberate audit work report

3. To examine laws enforcement

4. Individual cases examination of normative documents

5. In addition, there are inquiries and addressing inquiries, specific issues investigation, etc.

Power of personnel appointment and removal

When NPC is not in session, NPC Standing Committee has following functions and powers:

1. To decide candidate choice upon nomination by Premier

Ministers in charge of ministries

Ministers in charge of commissions

Auditor-General

Secretary-General

2. To appoint and remove, upon the Supreme People's Court President nomination

Supreme People's Court Vice-Presidents

Judges

Judicial committee members

Military courts presidents

3. To appoint or remove, at Supreme People's Procuratorate Procurator-General’s recommendation

Deputy Procurators-General of the Supreme People's Procuratorate

Procuratorial committee members

Procurators

Military procuratorates chief procurators

And to approve the appointment or removal of the chief procurators of the people's procuratorates of provinces, autonomous regions, and municipalities directly under Central Government

4. Upon Central Military Commission Chairman’s nomination, to decide candidate choice of all other Central Military Commission members

Decision-making power on major issues

1. When NPC is not in session, NPC Standing Committee has power to make decision on approval power aspect of partial adjustments on national economic and social development planning and state budget.

2. To have power on war state proclamation in the event of armed attack on country or in fulfilment of international treaty obligations concerning common defense against aggression.

3. To have power to decide on general mobilization or partial mobilization.

4. To decide country as a whole or particular provinces, autonomous regions or municipalities directly under Central Government to be under emergency state.

5. To decide on ratification or abrogation of treaties and important agreements concluded with foreign states

6. To institute system of titles and ranks for military and diplomatic personnel and of other specific titles and ranks

7. To institute state medals and titles of honor and decide on their conferment

8. To decide on special pardons grant

Other functions and powers

1. To annul those administrative rules and regulations, decisions or orders of State Council that contravene Constitution or laws.

2. To annul those local rules and regulations and resolutions of organs of state power of provinces, autonomous regions, and municipalities directly under Central Government that contravene Constitution, laws and administrative rules and regulations and to decide on appointment or removal of plenipotentiary representatives abroad.
