On February 26, 2010, the Supreme Court's Criminal Division for Holders of Political Positions handed down a verdict ruling that the 46 billion baht assets were confiscated since they were gained through malpractice during Thaksin's premiership.

The Nation online reported that the Supreme Court judges convened a full bench and voted to reject the appeal.

Thaksin was ousted by the military coup in September, 2006, in accusation of massive corruption, and kept in exile since then. Thaksin returned to Thailand in February, 2008 to face corruption charges, but he later fled into exile again and was convicted in absentia.
