International students can work to support their study in China

While studying at university in China, international students shall not take a formal job, go into business, or engage in other business activities, but can take a part-time job in accordance with university rules.

Working to support their study in China refers to social practices where a student makes good use of spare time to obtain lawful payment through work which is organized by the university, in order to improve study and living conditions.

International students working to support their study in China shall act in line with the laws and regulations, as well as the administration regulations of the universities or employment units, and honor relevant agreements on working to support their study in China.

  • Requirements for working to support the study in China

The requirements for working to support the study in China include: (1) being undergraduates, master degree students, doctoral degree students, general scholars and Chinese language students officially registered at the host universities and obtain the status as a student; (2) passing the exams of both compulsory courses and elective courses; (3) taking out comprehensive life insurance of international students.

  • Time limit and scope of working to support the study in China

The time limit of working to support the study in China: (1) for no more than 20 hours a week in school terms; (2) for no more than eight hours a day in school holidays.

The scope of working to support the study in China: (1) radio and television program production, commercialized performances or performances in commercialized entertaining places in which international students engage are not regarded as working to support their study in China; (2) when working to support their study in China, international students must act in line with Chinese laws and regulations.

  • Application for and registration of working

The foreigners holding study-type residence permits that need to work to support their study in China or have an internship off campus shall upon the approval of the university apply to the exit and entry administration department of the public security organ for adding to residence permit the information of the place or duration of the part-time job or internship. The foreigners holding study-type residence permits whose residence permit is not added the information prescribed in the preceding paragraph shall not work to support their study in China or have an internship off campus.

International students applying for working to support their study in China shall submit the following materials when applying for the registration: a photocopy of the agreement on working to support their study in China entered into with employers (stating the date, content, time, payment, and payment date of the part-time job), passport, student card, and foreigner residence permit.

International students working to support their study in China shall retain the relevant documents concerning the date, time, hours and payment, and comply with the laws and regulations including Labor Law of the People’s Republic of China.

  • Handling the accidents and disputes concerning working to support the study in China

Injuries and other accidents that occur to international students working to support their study in China shall be reported immediately to International Students Office and informed department of foreign affairs and public security bureau.

A dispute arising between an employer and an international student shall be settled in accordance with the agreement entered into between the two parties. If it can’t be settled through consultation, it can be arbitrated by labor dispute arbitration institution and International Students Office can provide necessary language assistance and policy advice for the settlement of the dispute.
