BEIJING - China has issued new judicial rules for the courts' asset enforcement practices to promote more efficient enforcement of court orders.
The new judicial interpretation, issued by the Supreme People's Court of China on Sunday, will take effect beginning Monday.
If all enforceable assets involved in a case are outside the jurisdiction of the court originally authorized for the enforcement, the court should authorize other courts at the same level where the assets are located to enforce the enforcement measures, the judicial interpretation said.
According to an official with the SPC's enforcement department, such rules will help to reduce costs incurred when judicial officials have to travel to other regions for enforcement, so that the enforcement could be carried out in a more economical and efficient way.
Moreover, the new rules could help minimize incidents of judicial corruption which occurred when the parties involved in cases often accompanied the officials throughout their trip for enforcement, the official said.
The new rules also stipulate that if the authorized court failed to complete the enforcement within six months after the authorization, the parties involved are entitled to appeal to a superior court for a decision for prompt enforcement.
